About FCIRS

Fiat Chrysler Investors Recovery Stichting ("FCIRS" or "Foundation") is an independent foundation established under Dutch law, with a Board of Directors and a Supervisory Board. The Foundation operates on a non-profit basis and represents affected investors in Fiat Chrysler (currently Stellantis) who seek compensation. Board and Supervisory Board members are remunerated for their time but have no financial interest in the outcome of the action.

Management Board

Flip Schreurs

Since 1989, Flip has been a lawyer, first at NautaDutilh, and per 1995 at Boels Zanders, a law firm in the Netherlands. In addition, Flip works as a judge sitting by designation at the Court of Appeal Arnhem-Leeuwarden. He is an expert in corporate governance and often deals with issues with (management) boards. Flip is a lecturer at the CPO Grotius specialization course in Corporate Litigation and publishes frequently in his field. As an expert in his field, Flip is regularly appointed as an official by the Enterprise Chamber of the Court of Appeal Amsterdam. Flip studied Civil Law in Utrecht and Tax Law in Leiden. Afterwards, he completed the Grotius specialization courses in Insolvency Law and Company and Business Law, and the specialization course in Financial Economics at Erasmus University. Flip has been a member and chairman of the board of INSOLAD, the association of Dutch Insolvency Lawyers. Flip is also a board member of the Stichting Petrobras Compensation Foundation, a foundation that seeks to recover investors’ losses collectively from the Petrobras group. He is also a member of the Association of Dutch Collective Interest Representatives (ANCB) on behalf of the FCIRS board.

Barbara van Hussen

Barbara is a partner at Van Hussen & Croiset van Uchelen and specialises in corporate law. Prior to this, she worked at JB Law and DLA Piper in the Netherlands, and for a short period at DLA Piper in London and Leeds. At DLA Piper, she held various senior positions, including that of a member of the International Executive Board. Barbara holds various supervisory and management board roles. She is also regularly appointed as an official by the Enterprise Chamber of the Court of Appeal Amsterdam. She also acts as an arbitrator (via NAI) and mediator. In 2011, she won the award for Best M&A Lawyer.

Dominiek Vangaever

Following 15 years with ING Group, Dominiek has held senior management positions in global financial institutions such as the African Development Bank, European Bank for Reconstruction & Development and InterAmerican Development Bank. Most recently Dominiek has been the Chief Risk Officer and Executive Director of a global NGO where he has been responsible for risk and compliance, fraud management and insurance. He is also a management board member of the Stichting Multilateral Interchange Fees Claims, a foundation representing Dutch companies in a class action against Visa and Mastercard, and the Airbus Investors Recovery Stichting, a Dutch Foundation representing investors in a mass claim against Airbus. Dominiek graduated from the Johns Hopkins University and the Bologna University, with a master’s degree in International Economics and European Studies after studying Law at the Universities of Antwerp and Leuven, Belgium.

Supervisory Board

Bonne van Hattum

Bonne van Hattum (PhD & LL.M) has been an expert in the field of behavioural risks – such as mass claims, class actions, liability, political interference, reputational damage and regulatory intervention – for over 20 years. She combines her practice as a strategic advisor (owner of The Evaluator), management board member (at Stichting Bescherming Consumentenbelang and Stichting Collectief Forward Gold Sale) and supervisory board member (at FCIRS) with both academia (Lecturer at Leiden University – Department of Corporate and Financial Law) and politics (councillor for D66 in Hilversum). Bonne is a public figure in her areas of expertise, among others through PAO education via AvdR, Nieuwsuur and Vara’s Kassa.

Matthijs Visser

Matthijs is an economist with over 25 years of professional experience. From 2004 to 2022, he worked at RBB Economics, an international consultancy specialising in competition and regulatory issues, for which he also established the Dutch office. His work focused on assisting clients in proceedings before competition authorities and in court cases. Before joining RBB, he worked at the Dutch competition authority, the European Commission and two other consultancy firms. In addition to his role as a supervisor at FCIRS and a similar role at Stichting Multilateral Interchange Fees Claims, he is a member of the board of the Aruba Fair Trade Authority (AFTA), volunteers as a board member of the Land van Ons citizens’ cooperative, and is active as an investor.

Guido Rooijackers

Guido has been a partner at Sman Business Value since 2002. He specialises in business valuation. He frequently acts as a court-appointed expert, including for the Enterprise Chamber of the Court of Appeal Amsterdam. As a court-appointed expert, Guido has advised on major buy-out proceedings. In addition, as a party-appointed expert, he has assisted around ten law firms in proceedings before the Enterprise Chamber concerning compensation for investors in SNS Reaal. He also specialises in the analysis of economic damage issues and regularly advises the Dutch government as an expert in this field. Guido studied financial business economics at Erasmus University Rotterdam. He completed the postgraduate programme to become a chartered controller at the University of Amsterdam and obtained the qualification of Chartered Valuator after completing the Business Valuation programme at the Rotterdam School of Management. Guido Rooijackers is registered in the National Register of Court Experts and is a member of the Dutch Institute of Registered Valuators. From 2006 to 2012, he served as a board member and secretary of this professional association. He is also a management board member of Stichting Essure Claims and Stichting Environment and Fundamental Rights.

Claim Code compliance

FCIRS complies with the principles of the Claim Code. FCIRS has drafted an accountability document (called Claim Code statement) in which FCIRS explains how it applies the Claim Code. The Claim Code statement can be found here.  

Reporting
FCIRS will keep affected investors informed on progress being made in its actions against Stellantis (as the legal successor of Fiat Chrysler). Investors who have signed up will be consulted in line with the Claim Code on material issues.  

Fees
The members of the Management Board and the Supervisory Board are paid on an hourly basis (EUR 300) for their services to FCIRS. FCIRS will report the amount of fees and expenses that have been incurred by the members of the Managing Board and the Supervisory Board in its annual report.

This claim is funded by an external financier associated with Fortress Investment Group LLC, which has its headquarters in New York. This is a reputable litigation financier at home and abroad. This party has indicated that it will assume the costs of the proceedings.
