Decision following the oral hearing - 23 July 2025
On 23 July 2025, the District Court of North Holland rendered its decision following the oral hearing in the proceedings brought by Fiat Chrysler Investors Recovery Stichting (“FCIRS”) against Stellantis.

In its decision, the District Court decided on the applicable collective action regime and the admissibility of FCIRS. The District Court held that the new collective action regime (allowing damages claims) is applicable. In addition, the District Court takes the view that FCIRS is not admissible to bring its claim under this new regime. The District Court considered that in its view it could not be established that FCIRS is sufficiently representative. The District Court did not allow FCIRS to further substantiate its position.

FCIRS disagrees with the District Court's view on the admissibility of FCIRS. FCIRS is considering to appeal the decision and will inform its constituency of further developments in due course. Oral hearing - 16 June 2025
On 16 June 2025, the first oral hearing took place in the proceedings brought by Fiat Chrysler Investors Recovery Stichting (“FCIRS”) against Stellantis.

During the oral hearing at the District Court of North Holland, various topics were discussed, including Stellantis' request to stay the proceedings pending the outcome of proceedings before the Dutch Supreme Court and the applicable collective action regime (i.e., the “old” regime or the “new” regime that allows claims for damages). The admissibility of FCIRS was also discussed.

The management and supervisory boards of FCIRS attended the oral hearing to answer questions from the court.

The district court expects to render its judgment on 23 July 2025. It is possible that this date may change and that the judgment will be rendered at a later date.

Participation in International Investors’ Conference - 12 June 2025
On 12 June 2025 Fiat Chrysler Investors Recovery Stichting (“FCIRS”) participated in an international conference addressing the protection of shareholder rights in Madrid (Spain).

The conference themed “Empowering Minority Shareholders and Advancing Individual Investor Rights” was organised by Better Finance. Better Finance is a public interest non-governmental organisation advocating and defending the interests of European investors. FCIRS’ board member Flip Schreurs participated in the panel ‘Advancing Collective Redress for European Shareholders Moderator’. The panel also included representatives of interest groups from Germany, the United Kingdom and Spain. On behalf of FCIRS experiences were shared with regard to litigation against a listed company in the Netherlands.

Participation meeting - 26 May 2025
On 26 May 2025, Fiat Chrysler Investors Recovery Stichting ("FCIRS") organised an online meeting with the aim of informing and consulting its constituency. Approximately 50 registrants participated in the meeting.

During the meeting, FCIRS, Better Finance and FCIRS's lawyers provided an update on FCIRS's efforts to date and explained the proceedings against Stellantis. In particular, the upcoming hearing on 16 June 2025 was discussed. Better Finance explained its background and the relevance of adequate investor protection. Participants in the meeting were given the opportunity to ask questions and provide feedback.
